On the Path to GDPR

The most significant, most challenging and most disruptive data protection regulation will go into effect on May 25, 2018. The European Union’s General Data Protection Regulation (GDPR) will have global impact for organizations inside and outside the European Union. Yet many companies are still ill prepared.

What is the GDPR?

In May 2016, the European Union (EU) passed the GDPR, which will go into effect on May 25, 2018. The GDPR will be the new primary law regulating how companies have to treat and protect the personal data of EU residents. It grants consumers far reaching rights and affects all organizations in an organization, including legal, compliance, information security, marketing, engineering, and HR.

Who needs to comply?

Any organization that offers goods or services to EU residents, collects data of EU residents, or has employees in the EU will have to prepare to be in compliance with the new law. Regardless of where the company itself is located or incorporated, if the company acts as a controller or only as a processor of data, it must comply with GDPR. Failure to comply can result in fines up to 20 million EUR or four percent of total worldwide annual revenue of the preceding year, whichever is higher.
